Staffnests Terms & Conditions – Updated

These Terms and Conditions (“Terms”) set out the agreement between Staffnests Ireland (“Staffnests”, “we”, “our”, or “us”) and you, the user of the Staffnests platform (“you”, “your”), including both landlords/advertisers and key worker/tenant users. By registering, creating an account, or publishing/using a listing on staffnests.ie, you agree to be bound by these Terms.

1. Scope of Agreement

1.1 Platform Purpose

Staffnests operates as an online accommodation listing and connection platform designed to help verified key workers find accommodation offered by landlords. Staffnests does not act as a landlord, letting agent, property manager, or intermediary in any tenancy or contractual relationship.

1.2 Priority for Key Workers

Staffnests specialises in supporting and prioritising key workers — including teachers, healthcare professionals, Gardaí, social care workers, and other essential service professionals — in accessing accommodation through our platform. All communications, matching processes, and platform features are designed to facilitate connections that reflect this mission. Claiming key worker status and any associated prioritisation is subject to verification as described below. This clause does not prevent non‑key worker users from accessing the platform where permitted.

1.3 No Agency Relationship

Staffnests is not an agent, representative, guarantor, or fiduciary of any user. Any lease, rental agreement, contract, or transaction arising from communication through the platform is made solely between the landlord and the tenant.

2. Eligibility, Registration, and Verification

2.1 Landlord Eligibility

You must be at least 18 years old, legally capable of entering binding contracts, and the legal owner or authorised representative of any property you advertise.

2.2 Key Worker Eligibility

To use Staffnests as a tenant and benefit from priority related to key worker status, you must:

  • Be a key worker by profession;

  • Provide your professional registration number or equivalent verification with an Irish governing body;

  • Upload documentation proving your employment or registration status;

  • Be at least 18 years old and legally capable of binding agreements.

2.3 Verification Process

Staffnests will review uploaded documentation and may verify key worker status at its discretion. Verification is not guaranteed and may be delayed. Staffnests does not guarantee continued eligibility after initial approval.

3. Listing Fees, Payments, and Pricing Parity

3.1 Fees

Landlords are required to pay listing or subscription fees as displayed on Staffnests. Fees are payable in advance and are non‑refundable except as required by applicable law.

3.2 Pricing Parity Requirement

When advertising a room or property on Staffnests, you agree that the rent charged or advertised must be equal to or lower than the rent advertised for the same room or property on any other accommodation platform, website, or listing service. You warrant that the rental price submitted is accurate and complies with this requirement for the duration of the listing.

4. Listing Standards, Landlord Obligations, and Enforcement

4.1 Accuracy of Listings

All property details, descriptions, photographs, and rental information must be true, accurate, and lawful.

4.2 Compliance with Laws

Landlords are responsible for compliance with all Irish rental and accommodation laws, including registration with the Residential Tenancies Board (RTB), health and safety standards, and equality legislation.

4.3 Enforcement of Pricing Parity

Staffnests reserves the right at its sole discretion to investigate advertised rents and to compare listings with those on other platforms. If Staffnests determines that a property is advertised at a lower rent elsewhere, or that pricing parity is breached:

  • Staffnests may remove or delete the advertisement immediately;

  • Staffnests may suspend or terminate the landlord’s account;

  • Staffnests may take any further action it considers appropriate.

No refund, credit, or compensation will be due for any removal, suspension, or deletion of a listing under this clause. This may be done without prior notice.

4.4 Staffnests Right to Edit Listings

Staffnests reserves the right, at its sole discretion, to edit, amend, or modify any listing to ensure compliance with applicable laws, equality and anti‑discrimination regulations, or platform rules. This includes but is not limited to:

  • Removing discriminatory language or content

  • Correcting misleading or inaccurate information

  • Adjusting content to comply with platform guidelines or Irish law

Such edits may be made without prior notice to the advertiser, and Staffnests shall not be liable for any consequences arising from these edits.

5. Platform Use and Communication

5.1 Access and Restrictions

Only verified key workers are permitted to contact landlords through the Staffnests platform, although listings may be viewed by all users where permitted by your account type.

5.2 User Conduct

You agree not to misuse the platform, including by sending spam, misrepresenting your identity, collecting other users’ data without consent, or bypassing Staffnests verification or pricing rules.

6. Liability, Risk, and Disclaimer

Staffnests provides the platform “as is” without any warranty. You assume full responsibility for verifying tenant identities, property suitability, legal compliance, and any agreements formed through use of Staffnests. Staffnests accepts no liability for loss, scams, damages, or any risks arising from use of the platform.

7. Termination and Suspension

Staffnests may suspend or terminate accounts, remove listings, or restrict access for breaches of these Terms, including pricing parity, verification, and content rules. No refund will be provided upon termination.

8. Governing Law

These Terms are governed by the laws of Ireland, and disputes will be resolved solely in the courts of the Republic of Ireland.

9. Changes to Terms

Staffnests may amend these Terms at any time. Updated versions will be published on the platform, and continued use constitutes acceptance of any changes.

These Landlord Terms and Conditions (“Terms”) set out the agreement between staffnests.ie (“staffnests”, “we”, “our”, “us”) and you, the landlord or property advertiser (“you”, “your”) regarding your use of the staffnests.ie website, platform, and services (collectively referred to as the “platform”).

By registering, creating an account, or publishing a listing on staffnests.ie, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Scope of Agreement

1.1 Platform Purpose

staffnests.ie operates as an online accommodation listing and connection platform that facilitates contact between verified key workers (“key workers” or “tenants”) and landlords offering accommodation. Staffnests does not act as a landlord, letting agent, property manager, or intermediary in any tenancy or contractual relationship.

1.2 No Agency Relationship

staffnests.ie does not act on behalf of any party in any property transaction and is not an agent, representative, guarantor, or fiduciary of any user. Any agreement, lease, or arrangement arising from communication through the platform is made solely between the landlord and the tenant.

1.3 Acceptance of Terms

By using the platform, you agree to comply with these Terms, the staffnests.ie Privacy Policy, and any other policies or guidelines published by staffnests.ie. If you do not agree, you must not use or access the platform.

2. Eligibility and Registration

2.1 Landlord Eligibility

You must:

  • Be at least 18 years of age and legally capable of entering into binding contracts;

  • Be the legal owner, authorised landlord, or properly appointed agent for the property you advertise; and

  • Be in full compliance with Irish housing and rental legislation.

2.2 Account Creation

To list a property, you must create a verified staffnests.ie account. You agree to provide accurate, current, and complete information during registration and to maintain it thereafter.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Staffnests accepts no responsibility for unauthorised access or misuse of your account.

  1. Listing Fees and Payments

3.1 Fees

Landlords are required to pay listing or subscription fees as displayed on staffnests.ie. Fees are payable in advance and are subject to change at any time.

3.2 No Refunds

All fees are non-refundable, including in situations where:

  • Your property remains unlet or does not generate inquiries;

  • There are delays in approval or moderation;

  • Your account or listing is suspended, removed, or edited for breach of these Terms; or

  • You choose to remove or deactivate your listing early.

3.3 Payment Processing

Payments are processed securely through third-party payment providers. Staffnests does not store or retain payment card details. You are responsible for ensuring that payment information provided is accurate and valid.

4. Listing Standards and Landlord Obligations

4.1 Accuracy of Listings

You warrant that all property details, descriptions, photographs, and rental information you provide on staffnests.ie are true, accurate, and lawful.

4.2 Legal Compliance

You are solely responsible for ensuring that your property and actions comply with all applicable Irish laws, including but not limited to:

  • The Residential Tenancies Acts 2004–2022 and any successor legislation;

  • Residential Tenancies Board (RTB) registration;

  • Minimum accommodation standards and safety requirements;

  • Fire safety and building regulations; and

  • Equality and non-discrimination legislation.

4.3 Landlord Due Diligence

While staffnests.ie may verify key worker credentials, it does not guarantee the authenticity or ongoing registration of any user. You are responsible for:

  • Conducting independent verification of any prospective tenant;

  • Validating their identity, employment, and suitability; and

  • Undertaking all necessary due diligence before entering into any arrangement.

4.4 Key Worker Priority 

Listings on staffnests.ie are prioritised for verified key workers, including teachers, healthcare professionals, Gardaí, and other essential service professionals. All users may view listings, and non-key workers can express interest or contact staffnests.ie directly for further information. Verified key worker status determines the order in which inquiries are handled and responses prioritised.

4.5 Pricing Parity Requirement

All listings must be advertised at a rent equal to or lower than the same property on any other accommodation platform or listing service. You warrant that the price is accurate and compliant for the duration of the listing.

4.6 Staffnests Right to Edit or Remove Listings

Staffnests may, at its sole discretion, edit, amend, or remove any listing to:

  • Ensure compliance with laws, equality or anti-discrimination regulations, or platform guidelines;

  • Correct misleading or inaccurate information; or

  • Address pricing parity breaches.

All edits or removals may occur without prior notice or refund. Staffnests shall not be liable for any consequences arising from such edits or removal.

4.7 Prohibited Content

You must not publish content that is false, misleading, defamatory, discriminatory, illegal, obscene, or infringes third-party rights.

4.8 Moderation and Approval

All listings are subject to moderation. Staffnests may reject, edit, suspend, or remove listings at its sole discretion, without liability or refund.

5. Platform Use and Communication

5.1 Access to Key Workers

Listings are prioritised for verified key workers. All users may view listings, and non-key workers can express interest or contact staffnests.ie directly. Verified key worker status determines the order in which inquiries are handled and responses prioritised.

5.2 Verification and Approval Delays

You acknowledge possible delays between submission and approval. Staffnests accepts no liability for lost opportunities or inconvenience caused by moderation or verification delays.

5.3 Independent Transactions

All communications, negotiations, and agreements between landlords and tenants occur independently. Staffnests is not a party to, and bears no responsibility for, tenancy agreements, contracts, or payments.

5.4 User Conduct

You agree not to misuse the platform, including by:

  • Collecting other users’ data;

  • Sending spam or unsolicited messages;

  • Posting false or misleading information; or

  • Misrepresenting your identity or property.

6. Liability, Risk, and Disclaimer

6.1 Platform Provided “As Is”

Staffnests is provided “as is” and “as available” with no warranty regarding accuracy, completeness, reliability, or suitability.

6.2 Landlord Responsibility

You assume full responsibility for verifying tenant identities, assessing property suitability, ensuring legal compliance, and managing agreements.

6.3 Exclusion of Liability

To the maximum extent permitted by Irish law, staffnests shall not be liable for direct, indirect, incidental, or consequential losses, including but not limited to:

  • Loss of income or profit;

  • Fraud or scams;

  • Hacking or cyberattacks;

  • Misrepresentation or errors in listings;

  • Emotional distress or stress;

  • Delays in verification;

  • Losses due to removal, suspension, or editing of listings.

6.4 Indemnity

You agree to indemnify and hold harmless staffnests, its owners, directors, employees, contractors, and affiliates from claims, damages, losses, or costs arising from your use of the platform, listings, or breach of these Terms.

7. Intellectual Property

7.1 Ownership

All content on staffnests.ie is owned or licensed by staffnests and protected under Irish and EU IP law.

7.2 User Content Licence

By uploading content, you grant staffnests a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt, and display content in connection with the platform.

8. Data Protection and Privacy

8.1 Data Use

All personal data is processed according to the staffnests Privacy Policy, compliant with GDPR and the Data Protection Act 2018.

8.2 Data Security

You acknowledge and accept the inherent risks of internet-based data transmission.

9. Termination and Suspension

9.1 Suspension or Termination by Staffnests

Staffnests may suspend or terminate your account, remove, or edit listings if:

  • You breach these Terms;

  • There is suspected fraud, illegality, or misuse; or

  • Operational or legal reasons require it.

9.2 Effect of Termination

No refund will be provided. Sections 4–8 survive termination.

10. General Provisions

10.1 No Waiver

Failure to enforce any provision does not constitute a waiver.

10.2 Severability

If any provision is invalid or unenforceable, the remainder remains in effect.

10.3 Governing Law

These Terms are governed by Irish law; courts of the Republic of Ireland have exclusive jurisdiction.

10.4 Amendments

Staffnests may amend these Terms at any time. Continued use constitutes acceptance of updates.

10.5 Entire Agreement

These Terms, together with the Privacy Policy, constitute the full agreement between you and staffnests.

1. Purpose of the Platform

1.1 Platform Role

Staffnests does not act as a letting agent, landlord, property manager, intermediary, or party to any tenancy, contract, or agreement.

1.2 Independent Users

1.3 Acceptance of Terms
Your use of the platform constitutes acceptance of these Terms, the staffnests.ie Privacy Policy, and any other published policies. If you do not agree, you must not use or access the platform.

2. Eligibility and Registration

2.1 Key Worker Eligibility
To access and use Staffnests as a tenant, you must:

  • Be a key worker as recognised under Irish government or sectoral standards (e.g., teachers, healthcare professionals, Gardaí, and similar essential services);

  • Provide your professional registration number or equivalent verification;

  • Upload valid documentation proving your employment or registration with a recognised governing body; and

  • Be at least 18 years of age and legally capable of entering into binding agreements. Staffnests

2.2 Verification Process
Staffnests will review registration details and uploaded documentation prior to granting you full access to contact landlords. Verification is conducted at Staffnests’ discretion and is not guaranteed. Approval is required before certain features become available. Staffnests

2.3 Approval and Delays
You acknowledge and accept that there may be delays in the verification process. Staffnests accepts no responsibility or liability for any losses, missed opportunities, or inconvenience due to verification or moderation delays.

2.4 Ongoing Compliance
You agree to maintain the accuracy of your information and promptly notify Staffnests of any changes to your employment status or professional registration.

3. Use of the Platform

3.1 Access and Communication
All users may view listings on staffnests.ie. Contacting landlords directly through the platform is available to verified key workers as part of our prioritised service. Non‑key workers and other users may express interest or request assistance via contacting staffnests.ie directly.

3.2 Account Security
You are responsible for maintaining the confidentiality of your account login details and any activity conducted through your account. Staffnests accepts no liability for unauthorised access or misuse.

3.3 Permitted Use
You agree to use the platform lawfully, responsibly, and in good faith. You must not:

  • Provide false, misleading, or fraudulent information;

  • Attempt to contact landlords outside the platform for deceptive purposes;

  • Post or transmit unlawful, defamatory, discriminatory, or offensive material; or

  • Interfere with, damage, or disrupt the operation of staffnests.ie.

4. Verification and Responsibilities

4.1 Staffnests Verification
Staffnests seeks to verify the professional credentials of users claiming key worker status, but this is not a guarantee of ongoing validity or future compliance.

4.2 Landlord Responsibility
While Staffnests undertakes initial verification, landlords are responsible for performing their own checks, including identity verification, employment confirmation, suitability assessments, and any due diligence before entering into any rental agreement or contract.

4.3 Tenant Responsibility
You are responsible for:

  • Ensuring the property meets your expectations and legal standards;

  • Conducting your own research and inspections prior to signing any agreement;

  • Verifying the legitimacy and identity of any landlord you contact; and

  • Exercising full due diligence when communicating or contracting through the platform.

4.4 No Guarantee of Property Quality or Availability
Staffnests makes no warranty that any property is safe, available, accurately described, or suitable for your specific needs. You use the platform entirely at your own risk.

5. Platform Limitations and Disclaimer

5.1 Platform Provided “As Is”
The staffnests.ie platform and all related services are provided “as is” and “as available” without any warranty, express or implied.

5.2 Independent Arrangements
Any tenancy, rental, or payment arrangement formed through staffnests.ie is made solely between you and the landlord. Staffnests is not a contracting party and is not responsible for the performance or non‑performance of any agreement.

5.3 No Guarantee of Contact or Availability
Staffnests does not guarantee that landlords will respond to inquiries, that contact will result in a viewing, or that a property will be available or suitable.

5.4 Phishing, Scams, and Fraud
Staffnests accepts no liability for any loss, damage, or harm resulting from phishing, scams, fraud, misrepresentation, or other deceptive conduct by landlords or other users. It is your responsibility to ensure the authenticity of any communication or offer received.

5.5 Delays and Downtime
Staffnests accepts no liability for any losses or inconvenience caused by website downtime, maintenance, moderation delays, or verification processing.

5.6 Buyer and Seller Beware
The platform operates on a “buyer beware / seller beware” principle. You agree to use staffnests.ie entirely at your own risk and to conduct all necessary due diligence.

6. Exclusion of Liability

6.1 General Exclusion
To the fullest extent permitted by Irish law, Staffnests shall not be liable for any direct, indirect, special, incidental, or consequential loss or damage of any kind, including but not limited to:

  • Loss of money, income, or opportunity;

  • Identity theft, hacking, or cyberattacks;

  • Psychological distress, stress, or emotional harm;

  • Misleading listings or inaccurate descriptions; or

  • Fraudulent landlord activity.

6.2 No Refunds or Compensation
Staffnests provides access to verified users free of charge. No refunds, compensation, or guarantees are available for any reason, including delays, verification issues, or unsuccessful inquiries.

6.3 Indemnity
You agree to indemnify and hold harmless Staffnests, its owners, directors, employees, contractors, and affiliates from any claim, cost, or loss (including legal fees) arising from your use of the platform, breach of these Terms, or interactions with landlords.

7. Data Protection and Privacy

7.1 Data Processing
All personal information submitted to staffnests.ie is processed according to the staffnests.ie Privacy Policy, which complies with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Data Protection Act 2018.

7.2 Data Security
While Staffnests takes reasonable steps to secure user data, it cannot guarantee complete security of any data transmitted online. You acknowledge and accept this risk.

8. Suspension or Termination

8.1 Platform Rights
Staffnests reserves the right to suspend, restrict, or terminate your account at any time and without notice if you:

  • Breach these Terms;

  • Provide false or misleading information;

  • Engage in fraudulent, abusive, or illegal activity; or

  • Are deemed to pose a risk to other users or the platform.

8.2 Effect of Termination
Termination may result in the loss of access to your account and data. Staffnests shall not be liable for any resulting loss or inconvenience.

9. Intellectual Property

9.1 Ownership
All design elements, software, text, and materials on staffnests.ie are owned or licensed by Staffnests and protected under Irish and EU intellectual property laws.

9.2 Permitted Use
You may use the platform solely for lawful personal purposes related to accommodation search and communication. Other uses (scraping, data mining, reproduction) are prohibited.

10. General Terms

10.1 Amendments
Staffnests may amend these Terms at any time. The latest version will always be available on the platform, and continued use constitutes acceptance of updated Terms.

10.2 Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland, and the courts of the Republic of Ireland shall have exclusive jurisdiction over any dispute arising from them.

10.3 Severability
If any part of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

10.4 Entire Agreement
These Terms, together with the staffnests.ie Privacy Policy, constitute the entire agreement between you and Staffnests regarding your use of the platform.
